Irving Independent School District v. Tatro
This case answers the question of whether or not schools are required to provide certain services to a child with physical disabilities if those services are needed during school hours. In this case, a child required catheterization once or twice during the school day. The school did not want to provide this service. The court decided that because the child would not be able to attend school without catheterization, and therefore would not receive the benefit of a FAPE, that the catheterization fell belonged in the category of “support services”, which is a category of “related services”, which are included under IDEA.
